These terms govern your use of the smilinghouse.com website, operated by Smiling House GmbH ("Smiling House", "we", "us"). By using the website you accept these terms. Terms for booking a stay are set out separately in our Booking Terms (/legal/booking-terms); terms for professional travel partners are set out in the Travel Partner Agreement (/legal/travel-partner-agreement).

2.Website content

We present a curated collection of privately owned holiday properties. Property descriptions, imagery, amenities, availability and indicative rates are provided with care but may change and are not a contractual offer. A stay is only confirmed under the Booking Terms once expressly confirmed by us in writing.

Displayed prices may be converted into your selected currency for convenience using recent exchange rates; the contractual price and currency are stated in your quote or booking confirmation.

3.Acceptable use

When using the website you agree not to:

• Use the site for any unlawful purpose or in breach of these terms.
• Scrape, harvest or systematically extract content, listings or imagery without our written permission.
• Interfere with the site's operation, security or availability.
• Submit false, misleading or third-party personal data through our forms.

4.Intellectual property

The website, its design, text, imagery, logos and databases are protected by copyright and other rights held by Smiling House, our property owners and partners, or their respective licensors. You may view and print pages for personal, non-commercial use; any other reproduction or use requires our prior written consent.

5.Liability

To the extent permitted by law, we exclude liability for damage arising from use of the website, from temporary unavailability, or from third-party websites we link to. Mandatory liability — including for gross negligence, wilful misconduct, and injury to life, body or health — remains unaffected.

7.Governing law and jurisdiction

These terms are governed by Swiss law, excluding its conflict-of-law rules. Exclusive place of jurisdiction is the registered seat of Smiling House GmbH, subject to mandatory consumer forums.
